On to Day 3 of deliberations
After two full days of deliberating, the jury in the Scesny case will be entering day three tomorrow. At just before 4 p.m., the court came back into session to address two questions asked by the jury. The first was a request for a flip chart to use in their deliberations and the second question was what would happen if they couldn’t come to an agreement today since one of the juror’s was scheduled to take a 10 a.m. flight the next morning. The answer: yes to the flip chart and if jurors could not reach a decision before 5 p.m., an alternate would take the place of the juror with the plane to catch and the jury would have to start deliberations anew.
That means some of the progress already made behind closed doors will be set back slightly. The jury reported it had reached a decision on one of the four counts Alex Scesny was charged with but hadn’t come to a unanimous decision on the others. When the jury comes back tomorrow, they’ll have to reopen discussion on the charge they already decided in order to accommodate the alternate.
